Our Commitment to Academic & Intellectual Property Rights

The Calcutta University Chemical Engineering Alumni Association ("CUChEAA") respects the legitimate intellectual property rights of authors, researchers, institutions, and creators. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) (17 U.S.C. ยง 512) and applicable Indian Copyright Laws. It is our strict policy to respond promptly to clear notices of alleged copyright infringement on our web portal and community forums.

1 Notice of Copyright Infringement (Takedown Procedure)

If you are a copyright owner, or an authorized agent thereof, and believe in good faith that any academic papers, seminar presentations, photographs, alumni directory data, or other content hosted on the CUChEAA platform infringes upon your copyrighted work, you may submit a written notification pursuant to the DMCA.

To be effective and acted upon by our Legal Committee, your notification must include substantially the following essential details:

1. Physical or Electronic Signature

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Identification of Copyrighted Work

Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single site are covered by a single notification, a representative list of such works.

3. Precise URL / Location Data

Identification of the material that is claimed to be infringing or to be the subject of infringing activity, along with exact URLs or specific page references sufficient to permit us to locate the material.

4. Contact Information

Information reasonably sufficient to permit CUChEAA to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.

5. Good Faith Belief Statement

A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. Penalty of Perjury Statement

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2 Counter-Notification Procedure

If you believe that your content or publication that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material on the CUChEAA portal, you may send a counter-notice containing the following information to our Designated Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location (URL) at which the content appeared before it was removed or disabled.
  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the courts located in Kolkata, India, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, CUChEAA will forward it to the original complaining party. If the complaining party does not notify us that they have filed an action seeking a court order to restrain infringing activity within 10 business days, we may restore the removed material at our sole discretion.

3 Repeat Infringer Policy

In accordance with the DMCA and our membership governance standards, CUChEAA has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, members, alumni authors, or registered users who are deemed to be repeat infringers. We may also at our sole discretion limit access to the web portal and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
